2. Scope of Application
These General Terms and Conditions of Sale (GTC) apply to all services offered by Thomas Vinay in the context of his activities relating to hiking guidance, therapeutic support and life coaching, provided to both private and professional clients.
The sole purpose of the website is to present the activities and to enable clients to make contact. No sales or online payments are made via the website.
Any booking implies the client’s full and unconditional acceptance of these GTC.
3. Description of services
The services offered include, in particular:
– hiking guidance (full day, half day, multi-day trips, individual or group),
– therapeutic support,
– life coaching.
The specific terms (content, duration, location, objectives) are agreed in advance with the client and set out in writing (signed quote, email or agreement).
4. Conditions of access to services
The customer declares that they are physically and mentally fit to take part in the services, in particular hiking activities. They undertake to disclose any medical contraindications, ongoing treatment or specific difficulties before the service begins.
The client takes part in hiking activities at their own risk and acknowledges that these activities involve risks inherent to the natural environment (falls, weather conditions, fatigue, uneven terrain).
They undertake to have suitable equipment and to strictly comply with the safety instructions provided by the service provider.
The service provider reserves the right to refuse or interrupt a service if safety conditions are not met or if the client’s behaviour is incompatible with the smooth running of the activity.
5. Prices
Prices for services are quoted in euros (€).
VAT not applicable, Article 293B of the General Tax Code.
The applicable rates are those in force on the day the service is confirmed. They may be set out in a personalised quotation.
6. Booking terms and deposit
A booking becomes firm after:
– written confirmation (email, signed quote or written agreement)
- The deposit paid constitutes a fixed compensation in the event of cancellation under the conditions set out in these Terms and Conditions.
7. Payment Terms
The following payment methods are accepted: credit card, bank transfer, cheque and cash.
The balance is payable before or after the service, as agreed in writing between the parties.
Any delay in payment may result in the suspension of services currently being provided.
8. Cancellation and postponement
Cancellation by the client:
All cancellations must be notified in writing.
– Cancellation more than 7 calendar days before the service: full refund of sums paid,
– Cancellation between 7 days and 48 hours before the service: if a deposit has been paid, it is retained by the service provider,
– Cancellation less than 48 hours before the service or the client’s failure to attend: the service is payable in full.
Cancellation by the service provider:
The service provider reserves the right to cancel or postpone a service in the event of force majeure, adverse weather conditions or any event compromising safety.
In such cases, a new date will be proposed or the sums paid will be refunded, without any additional compensation being payable.
9. Liability – therapeutic support
The service provider is bound by an obligation of means, not of result.
Therapeutic support and life coaching services do not in any way constitute medical or psychotherapeutic acts. They are not a substitute for medical, psychological or psychiatric care provided by a healthcare professional.
The service provider does not make any diagnoses and does not intervene in the client’s medical treatment.
The client acknowledges that they are solely responsible for their personal, health and life decisions taken before, during or after the support.
They acknowledge that the discussions, advice or support offered do not constitute prescriptions or instructions, and that they form part of a freely chosen personal journey.
The service provider shall not be held liable for any damage resulting from:
– failure to follow the instructions given,
– incorrect or incomplete information provided by the client,
– reckless or inappropriate behaviour,
– force majeure.
The client remains responsible for their personal belongings throughout the duration of the service.
10. Insurance
The service provider declares that they are covered by professional liability insurance appropriate to their activity.
The client is advised to ensure they have personal insurance covering the activities undertaken.
11. Personal data
The personal data collected is necessary for the management of services and customer relations.
In accordance with the GDPR, the customer has the right to access, rectify and erase their data by sending a request to the service provider’s contact email address: thomas.vinay@irss72.com.
12. Consumer Mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, the customer may, free of charge, refer the matter to a consumer mediator with a view to the amicable resolution of a dispute.
13. Governing law and disputes
These T&Cs are governed by French law.
In the event of a dispute, the parties undertake to seek an amicable solution before taking any legal action.
In the absence of an amicable agreement, the dispute shall be brought before the competent courts within the jurisdiction of the service provider’s place of business.
14. Acceptance of the T&Cs
These Terms and Conditions of Sale are deemed to have been accepted by the customer upon booking a service.
